Vizio has agreed to settle a 2018 class-action lawsuit regarding "false and deceptive" marketing of refresh rates in LCD TVs. Here is how you can file your claim.
Vizio marketed TVs with an "effective" refresh rate of 120Hz or 240Hz, despite the LCD panel only having 60Hz or 120Hz, based on the concept of motion smoothing – also known as the soap opera effect.
Vizio denies wrongdoing, according to the settlement agreement (link). While this practice is not uncommon in the TV industry, the distinction seemingly lies in Vizio actively referring to it as 'Hz' (Hertz) while other TV brands only quote a number.

The class-action lawsuit Jeffrey Koenig et al. v. Vizio from 2018 has been settled, and Vizio has agreed to pay out a total of $3 million to consumers who purchased a Vizio TV in California from April 30, 2014, until now.
As part of the settlement, Vizio has also committed to ceasing the advertising practice and to provide a limited one-year warranty to all buyers.
